The Warsaw Regional Court agreed with our appeal in a case brought to remove inconsistencies between the entry in the land and mortgage register of a historic palace in Warsaw and the actual legal status of the real property.
The first instance court rejected the claim brought by our client, stating that the perpetual usufructuary of the land on which a building is situated has no right to bring a claim for the removal of inconsistencies between the entry in the land and mortgage register and the actual legal status of a building situated on said land.
We successfully appealed the first instance judgment on behalf of our client and managed to convince the Warsaw Regional Court to change the first instance judgment in full by ordering the discontinuation of the land and mortgage register established for the building in question. This judgment is final and binding.
